Eagles Nest Campground & Canoe Rentals - Noel, Missouri

We believe if everyone follows the "Golden Rule" and uses common sense other rules are not necessary. However, we have a few polices which we hope will make everyone’s visit more enjoyable.

RENTAL AGREEMENT

This is to certify that I have this day rented and received from Eagles Nest Camp & Canoe Rentals for my personal use, the following described property:

I understand that participation in this activity and/or use of this equipment may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability.

I hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or conduct of the owners, agents, officers or employees of Eagles Nest Camp & Canoe, or by any other person.

I, on behalf of myself, my personal representatives and my heirs hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Eagles Nest Camp & Canoe and its owners, agents, officers and employees from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of the above equipment or my participation in this activity. I specifically understand that I am releasing, discharging and waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct by the owners, agents, officers or employees of Eagles Nest Camp & Canoe.

I agree to keep safely said equipment and to return it to Eagles Nest Camp & Canoe on demand and in as good condition as when

received, and in default thereof, I agree to pay to Eagles Nest Camp & Canoe all losses and damages that may be sustained by reason of any such failure: and I further agree, at my cost and expense, to defend you and save you harmless on account of any and all suits or demands brought or asserted by reason of injuries to any person or property whatsoever caused by the use or operation of said equipment while in my possession, and to pay all judgments, liens or other encumbrances that may be levied against you or the said equipment on account of the use thereof.

It is further understood that the undersigned will be liable for all losses or damage due to theft, fire or any other cause whatsoever, while said equipment is in his/her possession. Customer shall pay a penalty of $15.00 for each damaged or lost lifejacket, paddle, seat cushion or seat back and a penalty of up to $550.00 for each damaged, lost or unreturned canoe that must be retrieved at the owners expense. In the event that I go past or arrive late at the designated point of pickup, there will be an additional $10.00 charge per person per 1/2 hour.

I HAVE READ THE ABOVE WAIVER AND RELEASE AND BY SIGNING IT AGREE IT IS MY INTENTION TO EXEMPT AND RELIEVE EAGLES NEST CAMP & CANOE FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.

NO CASH REFUNDS.

These waterways are patrolled by McDonald County River Rescue and Water Patrol, Missouri Department of Conservation and the Missouri State Water Patrol. They enforce the laws of the State of Missouri and McDonald County, including a county ordinance banning glass on the waterways.
